Ok so this one is tricky but my ex has his own business and I’ve just checked my ato and he has said that for a past financial year that he has paid me $8000. When he never did. It says that I was employed by him and yes he did transfer money to my acc but it was for his own things, work boots, groceries for our children, alcohol for him!
I’m so angry and upset and he is acting like I’m dumb and it’s all allowed and fine. When I know this is so wrong.
I never reported any of this money either. As I wasn’t aware it was a wage. It was just my partner at the time being my partner!
Im scared and hurt and I don’t know what to do.

Not sure what the question is. He gave you $8,000 and you haven’t declared it? Is this what you mean?
Not the OP but obviously it's ok and common to share money with your partner. Now they have separated he has claimed that money as a wage when it wasn't at the time, it was just him paying for normal household expenses. She didn't declare it to Centrelink as part of her income because it wasn't. They shared money. He's possibly done this to bump her income up so he pays less child support and so he has an extra expense to claim to bring his income down and pay less child support.
We were together yes but had seperate accounts and we lived seperately. He had a drinking problem and would transfer me money from his account to get his alcohol or groceries or sometimes he would just put money in my acc.
Never once was it discussed that I was in fact employed by his business and these were wages. I’ve gone onto my ATO acc and it’s all there in an income statement.
I’ve gone back through and have messages that prove that what the money was for coincides with the dates that it was sent. But I guess I’m asking if what he has done is legal?
How does he have your TFN if you weren't an employee?
Of-course it's illegal.
Call the ATO, you shouldn't be penalised for this.
However, if it is your only income, there would be no tax payable and I don't think that much would affect any Government entitlements?

Most husbands and wives who own businesses income split, however, as you are broken up, he should have at least given you a heads up.
Do you use the same accountant as him?

Yes I would be ringing Ato and telling them he has ilegally used your tax file number. ask them for advice and go from there. Does he have kids to someone else? Was he doing this to dodge child support or something. Either way let Ato know as it would have to have your signature on it, wouldn’t it? it sounds ilegal if you know nothing about it and he’s used your tax file number. Give them a call tomorrow. They will give you the right advice. Don’t stress too much. This is on him.
Before we broke up there was talk of me starting to do his book work where he acquired my TFN so I’d say then. He’s saying his accountant has a lot to do with it. But it just seems so dodgy. I can’t imagine an accountant being in on this unless they’ve been given a completely different story.
Accountants do it all the time for family businesses/trusts, but both partners are on board and the tax advantage is shared by the entire household obviously. Perhaps he doesn't know you have split? Please give the accountant a call and explain the situation to him, trust me, unless he's a rare dodgy guy, he will want to fix this. Your ex is not worth him getting in trouble with the ATO. Hey you might get a refund if you were paid in lump sums lol rather than regular weekly payments.

Yeah they’re common. An ex boyfriend of mine had a father who was an accountant and went to jail for tax fraud
