Driving charges.

Does anybody have an idea of what charges may be laid for mid range drink driving, negligent driving and dangerous driving causing grevious bodily harm in NSW?

I would suspect jail time or a suspended sentence at bare minimum.

Fine, loss of licence and depending on history maybe a suspended sentence.

If there's been previous charges they will likely give them a pretty harsh punishment.

Hopefully punishment will be severe enough to be a deterrent for this to never happen again....

Jail. Potentially add in attempted murder if they wish too.

Interlock will be placed on when they get out of jail. Obvious loss of license for X time. Fines to pay $$

The maximum penalty is 7 years jail. Courts rarely impose the maximum sentence so that is in their favour I guess.

In QLD someone I know who was caught mid range, no negligence or harm charges got a few grand in fines 14 months with no licence and 18 months after that with an interlock. Varies by judge too.

You would really hope with those charges the person would serve prison time. Drink drivers are scum and deserve the maximum force of the law

Yep. My brother in law was hit by a drunk driver. He was crossing a road one evening. My BIL was a GP, who sustained horrific brain damage and lives in a nursing home now. Scum is the polite word for drink drivers.

I know someone in QLD that was sentenced to 6 months jail for assault occasionally bodily harm (not traffic related) no prior history of assault and a few traffic offences. I’d say with the above charges a custodial sentence is likely.

He’s been charged with those offences. The correct question is what sentence will they receive. Seek legal advise.

NSW has particular legislation. All states have particular legislation.
DUI is a defence in QLD not sure on other states. Get a good lawyer. If the driver fucked up - well that’s life - gotta deal with it.
